Terms & Conditions
General
- Notwithstanding delivery and the passing of risk, property in and title to the goods shall remain with us until we have received payment of the full price of
- all goods and/or services the subject of the contract
- all other goods and/or services supplied by us to you under any contract whatsoever
- Payment of the full price shall include, without limitation, the amount of any interest or other sum payable under the terms of this and all other contracts between the us and you
- We reserve the right to await confirmation of payment, such as clearance of a cheque, before dispatching or releasing work
- Our work is priced in GB pounds. Where charges are incurred in the payment process, such as for credit card use, bank fees or exchange rate variations, these will be added to the purchase price
- Where work is sent to you we will select an appropriate method of packing and carriage, for which a charge will be made. We will inform you of the date of dispatch and expected date of delivery. If items are not received as expected you must inform us immediately. If items arrive damaged you must inform us within 48 hours of receipt and retain all packaging as received in case it is required for inspection
- If we are unable to deliver an item on time, or at all, our liability shall be limited to the agreed price of that item. We shall not be liable for any consequential loss
- Whilst we take every care during construction we shall not be liable for deterioration of the work, such as, but not limited to, fading, discolouration, cracking, lifting or warping, where our care advice has not been followed, nor beyond 6 months of completion
- If you do not require an item we may, at our discretion, accept it back in return for a full or partial refund provided it is complete, in original condition and undamaged. All return carriage and insurance charges must be paid by you and the item is carried at your risk
- Terms and conditions, and any dispute relating to them, shall be governed by the law of England and Wales
Commissioned Work
- You will pay a non-refundable deposit of between 20 and 50% of the agreed price before work will commence. The amount of the deposit will depend on the subject matter of the work and shall be at our sole discretion. Further non-refundable, staged payments may be required for large or unusual commissions
- Your artwork or photographs are accepted on the understanding that you own, or have permission to use, the copyright of those items. You will absolve us of any responsibility regarding copyright claims relating to items you provide
- Should you fail to purchase an item you have commissioned, you automatically give us the right to sell the work elsewhere, even where you or another party own the copyright of the source artwork. We may not, however, create further exact copies of such work without your permission
- We may use images of commissioned work in our publicity and promotional material except where specific limitations have been agreed between us, in writing
- Where we have designed an item to meet your requirements then we may make further, similar items except where exclusivity has been agreed between us, in writing
- We may use photographs and descriptions of commissioned items in our publicity material and website except where exclusivity has been agreed between us, in writing. However we will not identify you in such material unless we have your written permission
